These Terms of Service ("Terms") govern your access to and use of the services provided by Pipeline Labs LLC ("Pipeline Labs", "we", "us"), including our data products available via the Apify Marketplace and any future platforms. By accessing or using our services, you agree to be bound by these Terms.

1. Services

Pipeline Labs provides B2B data infrastructure services, including contact intelligence data, search infrastructure, and related data products ("Services"). The Services are intended exclusively for use by businesses and professionals for legitimate B2B purposes. Our Services are not directed at consumers or individuals acting in a private capacity.

2. Eligibility

You must be at least 18 years of age and acting in a professional or business capacity to use our Services. By using the Services, you represent that you have the legal authority to enter into these Terms on behalf of yourself or your organisation.

3. Permitted Use

You may use the data and Services provided by Pipeline Labs solely for:

• Legitimate B2B prospecting, outreach, and sales development
• CRM enrichment and business intelligence
• Market research and account-based marketing
• Other lawful commercial business purposes

4. Prohibited Use

You must not use our data or Services to:

• Send unsolicited communications in violation of applicable anti-spam laws (including CAN-SPAM, CASL, or similar)
• Harass, threaten, or abuse any individual
• Engage in discriminatory practices based on any protected characteristic
• Build, train, or improve a competing data product or database without our prior written consent
• Resell or redistribute our raw data to third parties without a separate written agreement
• Circumvent any technical restrictions or access controls on our platforms
• Violate any applicable law or regulation

5. Data Usage & Compliance

You are solely responsible for ensuring that your use of any data obtained through our Services complies with all applicable laws, including data protection legislation (GDPR, CCPA, CAN-SPAM, CASL, and others as applicable in your jurisdiction). Pipeline Labs provides data sourced from publicly available professional records; it is your responsibility to use such data lawfully.

Enterprise clients receiving data from Pipeline Labs acknowledge that such data is provided for B2B business purposes only and agree not to use it in any manner that would violate the privacy rights of the individuals to whom the data relates.

6. Intellectual Property

All intellectual property rights in our platforms, software, systems, and proprietary data infrastructure remain the exclusive property of Pipeline Labs LLC. Nothing in these Terms grants you any rights in our intellectual property beyond the limited licence to use the data as set out herein.

7. Disclaimer of Warranties

The Services and data are provided "as is" and "as available" without warranties of any kind, express or implied. Pipeline Labs makes no warranty that the data is complete, accurate, or up to date at any particular point in time. Contact data reflects publicly available information and may become outdated.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Pipeline Labs LLC, its members, officers, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or reliance on the Services, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amounts paid by you to Pipeline Labs in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pipeline Labs LLC and its officers, members, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Services.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Continued use of the Services following any modification constitutes your acceptance of the revised Terms.

11. Termination

We reserve the right to suspend or terminate access to the Services at our discretion, including where we reasonably believe you have violated these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, unless both parties agree otherwise in writing.
